The Alberta Court of Queen’s Bench has ruled that TMJ Dysfunction is not a “Minor Injury” under the Minor Injury Regulations. See Sparrowhawk v. Zapoltinsky, (2012) A.J. No. 54 (Q.B)(Q.L.)
However, the legislature amended the Regulations such that Injuries to the musculature of the jaw are caught by the definition. TMJ is not subject to the MIR if the TMJ involves damage to the bone or teeth or damage to or displacement of the articular disc.
