The burden of proof is the obligation to present evidence to support the plaintiff’s claim in a legal dispute. In a motor vehicle accident claim, the burden of proof can be thought of as proving that the accident resulted in the injuries claimed by the plaintiff due to the actions of the defendant (the driver of the at-fault vehicle).
